Triple talaq is a type of divorce which is used by the Muslim of India. It is also known as talaq-e-biddat, talaq-e-mughallazah, and instant divorce. This special type of rituals is followed by Hanafi Sunni Islamic schools. It is a legal process in which any Muslim men of India divorce his wife by just talaq word, three times in written, oral etc. But this type of divorce ('talaq' Arabic word for divorce) is not common to all society worldwide.
The union govt. of India has given the example of many Muslim countries, even Pakistan has forbidden this. It has procreated debate for the rights of Muslim women as this issue comes under the Muslim personal law. In the recent news, this has attracted more attention when (BMMA) Bharatiya Muslim Mahila Andolan made a request to govt to make a law against it. The number of times Prime minister Narendra Modi hail it as "justice for Muslim women".
According to a study conducted by (BMMA) that more than 91 percent of women approximate 4800 desired to ban this type of divorce.
JUDGEMENT: The five judges of the supreme court are Chief Justice JS Khehar, a Sikh, UU Lalit a Hindu and Abdul Nazeer a Muslim, RF Nariman a Parsi, Justices Kurian Joseph a Christian. By this bench, three judges gave their verdicts that it is unconstitutional and two upheld i.e 3-2 majority.
On 28 December 2017, Lok Sabha passed the bill and made it illegal in any form. Punishment for this three years' imprisonment (non bailable ).
